AMEND by inserting the following after line 524:

(20) Individuals who are eligible for Medicare, who otherwise would not be eligible for Medicaid because of their income or resources and whose income does not exceed one hundred thirty-three percent (133%) of the federal poverty level.

The eligibility of individuals covered under this paragraph (20) shall be determined by the Division of Medicaid. Individuals who are determined eligible shall only receive prescription drugs covered under Section 43-13-117(9) and not any other services covered under Section 43-13-117. However, any individual eligible under this paragraph (20) who is also eligible under any other paragraph of this section shall receive the benefits to which he or she is entitled under the other paragraph, in addition to prescription drugs covered under Section 43-13-117(9).

The Division of Medicaid shall apply to the United States Secretary of Health and Human Services for a federal waiver of the applicable provisions of Title XIX of the federal Social Security Act, as amended, and any other applicable provisions of federal law as necessary to allow for the implementation of this paragraph (20). The provisions of this paragraph (20) shall be implemented from and after the date that the Division of Medicaid receives the federal waiver.

AMEND FURTHER on line 1065 by deleting the period and inserting the following:

; however, exceptions for up to ten (10) prescriptions per month shall be allowed, with the approval of the director.

AMEND FURTHER the title on line 37 by inserting the following after the comma:
